Terms of Service

Stack Dollars — Effective Date: April 26, 2026

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and Dreamers Only LLC, an Illinois limited liability company doing business as Stack Dollars, located at 1655 S Blue Island Ave #541, Chicago, IL 60608 ("Stack Dollars," "we," "us," "our"). By accessing or using the Stack Dollars mobile application, website, or any related services (collectively, the "App"), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

2. Eligibility

• You must be at least 4 years old to use Stack Dollars.
• Users under 13 may play the game without creating an account. Account creation and social features (leaderboards, friends) require users to be at least 13 years old.
• Users between 13 and 18 must have the consent of a parent or legal guardian.
• By creating an account, you represent and warrant that you meet these age requirements.

3. Account Registration

• You may sign in using Apple Sign-In, Google Sign-In, or as an anonymous Guest. Stack Dollars does not maintain its own password system.
• You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must provide accurate information and keep it current.
• Usernames must not impersonate others, contain offensive or hateful language, promote illegal activity, or otherwise violate these Terms.
• You may not create more than one account. Duplicate or fraudulent accounts may be permanently banned without notice.
• You must notify us immediately at help@stackdollars.com if you suspect unauthorized access to your account.

4. Acceptable Use

You agree not to:

• Cheat, hack, exploit bugs, or use glitches to gain an unfair advantage or manipulate scores
• Use automated bots, scripts, macros, or third-party tools to interact with the App
• Harass, threaten, bully, or abuse other users in any way
• Create usernames or content that is offensive, hateful, discriminatory, or sexually explicit
• Attempt to reverse-engineer, decompile, disassemble, or modify the App or its source code
• Interfere with, disrupt, or overload the App's servers, networks, or infrastructure
• Circumvent any security, authentication, or access control measures
• Use the App for any unlawful purpose or in violation of any applicable law or regulation
• Impersonate Stack Dollars, its employees, or any other person or entity
• Scrape, harvest, or collect data from the App without our written consent

5. In-App Purchases

• Stack Dollars may offer virtual items, cosmetic upgrades, or subscriptions for purchase ("Virtual Items").
• All purchases are processed exclusively through Apple App Store or Google Play and are subject to their respective refund policies and terms.
• All purchases are final and non-refundable except as required by applicable law or the policies of Apple or Google.
• Virtual Items have no real-world monetary value and cannot be transferred, traded, sold, or exchanged for real currency outside the App.
• Prices are displayed in your local currency and may change with reasonable notice.
• We reserve the right to manage, modify, or discontinue Virtual Items at any time.

6. Leaderboards and Fair Play

Stack Dollars maintains automated and manual systems to detect cheating, score manipulation, and fraudulent activity. We reserve the right to:

• Remove fraudulent, suspicious, or illegitimate scores from leaderboards without prior notice
• Temporarily suspend or permanently ban accounts found to be cheating or violating these Terms
• Disqualify users from events, challenges, daily competitions, and seasonal leaderboards
• Reverse, revoke, or reclaim any rewards, badges, or Virtual Items earned through illegitimate means

Our decisions on fair play matters are final and binding. Repeated violations may result in permanent account termination.

7. User Content

By setting a username or participating in social features, you grant Stack Dollars a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your username and publicly visible game data (scores, badges, leaderboard rankings) within the App and associated marketing materials. You retain ownership of any original content you create.

We reserve the right to remove any user content that violates these Terms without notice.

8. Intellectual Property

Stack Dollars and all content within the App — including but not limited to graphics, artwork, music, sound effects, game mechanics, user interface designs, text, logos, trademarks, trade dress, and source code — are the exclusive property of Stack Dollars or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of the App without our prior written consent. "Stack Dollars" and associated logos are trademarks of Stack Dollars. Unauthorized use is strictly prohibited.

9. Third-Party Services

The App may integrate with or link to third-party services, including:

• Apple App Store and Google Play (distribution and payments)
• Push notification delivery services
• Cloud hosting providers

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the content, practices, or availability of third-party services.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

Some jurisdictions do not allow the exclusion of certain warranties, so the above exclusions may not apply to you in full.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STACK DOLLARS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) TEN UNITED STATES DOLLARS ($10.00 USD).

Some jurisdictions do not allow limitations on liability, so the above limitations may not apply to you in full.

12. Indemnification

You agree to indemnify, defend, and hold harmless Stack Dollars and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit or transmit through the App.

13. Termination

• By you: You may delete your account at any time via Settings → Delete Account. Your data will be permanently deleted within 30 days in accordance with our Privacy Policy.
• By us: We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our reasonable discretion, with or without notice.
• Upon termination, your right to access and use the App ceases immediately. Any Virtual Items associated with a terminated account are forfeited.
• Sections 7 (User Content), 8 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), and 14 (Governing Law) survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to conflict of law principles.

Informal Resolution: Before filing any formal dispute, you agree to first contact us at help@stackdollars.com and attempt to resolve the dispute informally for at least 30 days.

Arbitration: If informal resolution is unsuccessful, any dispute shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Cook County, Illinois, or remotely at your election.

Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this waiver is found unenforceable, the entirety of this arbitration provision shall be void.

Exceptions: Either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the infringement of intellectual property rights or other irreparable harm.

15. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Effective Date" at the top of this page
• Provide notice through the App (in-app notification or banner)

Your continued use of the App after updated Terms are posted constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the App and delete your account.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Stack Dollars regarding the App and supersede all prior agreements, communications, and understandings.
